but keep in mind, that private operation of a steam boiler on wheels is likely subject to strict liability due to being very dangerous - these things have been known to explode and also pose a potential fire risk. Of course, so have steam locomotives which is why in law school, they used to (and likely still do, I only graduated 5 years ago) teach assignment of risk in tort law using steam locomotives and fires (which was a very common occurrence during the steam locomotive era before laws required the row to be clear of vegetation). That is why old railroad right of ways are so much wider than the tracks - it was to keep the tracks clear to avoid brush and forest fires. |
